These terms are a licence agreement between you and ORamaVR SA, Route de la Galaise 34, c/o Fongit, CH-1228 Plan-les-Ouates, Geneva, Switzerland ("ORamaVR", "we"), for the mobile application Robotic Readiness (the "App"). The App is a free, hands-on demonstration of a robot-assisted surgical training simulation for XR headsets and smart glasses. By tapping "Agree" at first launch, or by using the App, you accept these terms. If you do not accept them, do not use the App.
These terms replace any default licence terms that would otherwise apply under the Google Play Terms of Service.
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you control, for your own demonstration and evaluation purposes only. The App is licensed, not sold. We and our licensors retain all rights in the App, its content and the technology behind it.
use the App or its content for clinical work, patient care, or the actual training, assessment or certification of medical skills;
use the App for any commercial purpose, or offer it (or access to it) to others for a fee;
copy, modify, distribute, sell, rent or sublicense the App, or extract or reuse its content, models or assets;
reverse engineer, decompile or disassemble the App, except to the extent a mandatory law allows it despite this term;
remove or obscure proprietary notices, or use the App in breach of applicable law.
The App is a demonstration only. It is not a medical device, does not provide medical advice, diagnosis or treatment, and is not a substitute for professional medical education, surgical training or clinical judgement. Nothing you see or practise in the App qualifies you to perform any medical procedure. Do not base any clinical decision on the App.
The App includes an optional voice assistant, JARIA. JARIA is an artificial-intelligence system: you are interacting with software, not a person. Its responses are generated automatically and may be incomplete, outdated or wrong. They are provided for the purposes of the demonstration only and are not medical, professional or other advice. The assistant works only if you grant microphone permission; how voice data is handled is described in the Privacy Policy (section 8 below).
You have no obligation to give us feedback. If you choose to, you grant us the right to use it without restriction or compensation; feedback must not include anyone else’s confidential information.
The App is a demonstration project. We may update, change, suspend or discontinue it, or these terms, at any time without notice. Changed terms apply from the date shown above; your continued use is acceptance. The licence ends automatically if you breach these terms; you can end it at any time by deleting the App.
How the App handles data is described in the Robotic Readiness Privacy Policy at oramavr.com/privacy/robotic-readiness. In short: no account, no advertising, nothing stored by ORamaVR after your session.
The App is provided free of charge and "as is", without any warranty of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement, to the extent such warranties can be excluded under applicable law. We do not warrant that the App will be uninterrupted, error-free or compatible with your device.
To the extent permitted by applicable law, ORamaVR’s total liability in connection with the App is excluded; in particular we are not liable for indirect or consequential loss, loss of data, or damage resulting from use of the App contrary to sections 3 or 4. Nothing in these terms excludes or limits liability for intent or gross negligence, for death or personal injury caused by our negligence, or any other liability that cannot be excluded by law, including rights you have as a consumer under the mandatory law of your country of residence.
These terms are governed by Swiss law. The courts of Geneva, Switzerland have jurisdiction, except where the mandatory consumer-protection law of your country of residence gives you the right to sue or be sued elsewhere.
